1. Identification

These general terms and conditions of sale (‘Terms’) are offered by AZUP AUTOMOBILES, a French SAS with share capital of €2,000, registered with the Paris Trade and Companies Register under number 910 617 067, whose registered office is at 102 avenue des Champs-Élysées, 75008 Paris, France. Intra-community VAT number: FR55910617067. The company trades as Blue Prestige (‘Blue Prestige’).

Contact and complaints: contact@blueprestigemobility.com ; +33 7 49 21 64 39; by post to the registered office. Information about the publisher and insurance appears in the legal notice.

2. Services and Blue Prestige's role

The Terms govern chauffeur transfers to or from an airport, station or address, chauffeur hire and personalised welcomes confirmed by Blue Prestige. The main area is Paris and Île-de-France. Any assignment in another region or abroad requires assessment and written conditions adapted to local rules.

Blue Prestige acts as a booking centre within the meaning of Articles L. 3142-1 et seq. of the French Transport Code. It organises the service, sets and communicates its price, receives the order, appoints the operator, provides coordination and invoices the client. Journeys are carried out by independent private-hire operators using vehicles available to them. Using partners does not remove Blue Prestige's liability described in Article 14.

Assigning a journey requires checking the operator's, driver's and vehicle's regulatory documents under Articles L. 3141-2 and R. 3141-1 et seq. of the French Transport Code. An assignment cannot be allocated without the required valid documents.

Airport ‘fast track’ services and unaccompanied luggage transport are separate from passenger transport. Their scope and applicable rules are specified in Article 13 and in a specific quotation.

3. Clients and passengers

The client is the natural or legal person identified as the contracting party in the quotation or confirmation. Payment by a third party does not itself change that identity. When an assistant, hotel, concierge service or company acts for another person, it specifies whether it contracts in its own name or as an authorised agent.

A consumer client acts for purposes outside their professional activity. A business client acts for their business needs. Non-professional legal entities retain the protections recognised by law; they are not automatically treated as traders.

The passenger is the person transported. The booker communicates useful instructions and personal-data information to them. The booker cannot waive the passenger's statutory rights on their behalf.

4. Enquiry, quotation and booking

Enquiries are received through the website, email, WhatsApp or telephone. The simulator and forms prepare an enquiry: they constitute neither a binding offer, a confirmed booking nor a payment. The 12-hour lead time before pickup is a recommended organisational period; later enquiries are assessed according to availability.

Before any commitment and payment, Blue Prestige provides in writing the service description, its price including tax or calculation method, foreseeable supplements, payment and cancellation arrangements and the applicable version of the Terms. The client can check and correct the information before accepting it. Unless the quotation states another period, it is valid for 30 days; availability for the requested date must be confirmed.

The booking is concluded when the client receives Blue Prestige's written confirmation accepting their order, following their agreement to these elements and advance payment where required. A quotation accepted and signed by both parties constitutes confirmation. A simple acknowledgement or estimate does not. No price increase or new condition may be imposed at confirmation without the client's renewed agreement.

Confirmation sent by email or another retainable written medium identifies the client, service, pickup date, time and place, destination or programme, vehicle category, planned passengers and luggage, price and contact arrangements. The accepted Terms are attached or supplied in a retainable format. If a paid order cannot be confirmed, its payment is refunded in full no later than 14 days after notification of refusal.

The regulatory advance-booking document intended for transport inspections is prepared with the mandatory particulars, including the operator, its private-hire registration and identity, the client and required dates, times and location. An incomplete commercial message is not a compliant document. The operator must be able to present it before and during the assignment.

The client checks, in particular, the flight or train number, addresses, passenger and luggage numbers and a telephone number reachable on the travel day. The consequences of an error are assessed according to its actual impact and each party's responsibility.

5. Prices and supplements

Public prices are in euros including tax, per vehicle and per journey or chauffeur-hire package. Business quotations may distinguish the amount excluding tax, VAT and total including tax. Website estimates and the tariff schedule are reference indications; the contractual price is the one accepted before booking. VAT rules are those applicable to the service concerned.

The quotation specifies what is included: duration, mileage, welcome and waiting. Tolls and parking not included are disclosed before commitment, with an amount or, where it cannot reasonably be established, a calculation method. They are charged at the actual, substantiable cost incurred. Any event-related surcharge appears in the price offered before acceptance.

Additional waiting, requested stops and excess time or mileage are priced according to the schedule supplied with the quotation or accepted specific conditions. They cannot be charged without prior information and agreement on their price or calculation method. Normal traffic does not increase an already accepted fixed transfer price.

The Prices page presents reference amounts and inclusions. Expressly accepted specific conditions prevail on the matters they address without excluding mandatory statutory provisions.

VAT applicable to services and billing arrangements
Prices include all taxes. An invoice is issued for each service; business accounts may receive a consolidated invoice at the end of the month.

6. Payment and invoices

For a consumer client, full payment is requested after acceptance of the proposal and before booking confirmation. For a new business client, the first assignment is also paid in full in advance. The requested payment is an advance payment of the price, not a right to withdraw for a fee. Refunds provided for in these Terms remain applicable.

After a business account is opened and accepted, subsequent assignments are payable within 30 days of the invoice date, unless lawful specific conditions are expressly agreed. No 30% deposit is automatically added to full payment for the first assignment.

The methods currently offered are bank transfer and a Qonto payment link sent by Blue Prestige. This showcase website collects no payment. Stripe payments from the former booking platform are not offered on this website; that platform is closed for redesign.

Invoices are emailed after the service or, for business accounts that have agreed this arrangement, as part of monthly billing. Authorised supplements are itemised; their due date is specified before acceptance.

For a consumer, interest at the statutory rate may be due following a legally compliant formal demand. The €40 fixed recovery fee specific to business relationships is not applied to them. Payment difficulties never justify abandoning a passenger in a dangerous situation. Any suspension of future orders must be notified and take account of commitments already concluded.

7. Changes requested by the client

A change of time, address, programme, vehicle category or passenger numbers should be requested in writing as soon as possible. It remains subject to availability and Blue Prestige's confirmation. The new price requires the client's agreement before performance.

A change requested at least 12 hours before pickup carries no additional administrative fee; only the accepted difference in service is charged. Within 12 hours, price consequences are specified before agreement. If the change is impossible, the original booking remains applicable; the client may choose to cancel under Article 8. Refusal of a change does not itself constitute cancellation.

8. Cancellation by the client

Cancellation is communicated as soon as possible by email or WhatsApp. It may also be notified by telephone; Blue Prestige then sends written confirmation. The actual, demonstrable receipt time of the request applies, without postponing an established telephone cancellation to the time of a later written record. Times are Paris local time unless the booking specifies otherwise.

Scale applicable to confirmed transport services
Time before pickupCharge
At least 24 hoursNone
From 12 hours inclusive to less than 24 hours50% of the agreed price
Less than 12 hours100% of the agreed price

The scale covers transfers and chauffeur hire, including several vehicles where no separate specific conditions have been accepted. The basis is the price of the cancelled transport, excluding supplements not performed and expenses not incurred. No second compensation is added for the same loss. For a partial cancellation, only the cancelled portion is considered.

These charges do not apply to free cancellations under Articles 10, 11 and 15 or where a statutory right requires another solution. They remain subject to proportionality review and rules on unfair terms and penalty clauses. Amounts due back are refunded no later than 14 days after cancellation, using the original payment method where possible, without imposing a credit note.

9. Waiting and passenger no-shows

On arrival of a flight whose number has been provided, 60 minutes of waiting are included from actual landing. At a station, where the train is identified and monitored, 15 minutes are included from actual arrival. For other pickups, 15 minutes are included from the agreed time. Any other starting point for waiting must be expressly agreed.

Beyond this, continued waiting depends on driver availability and agreement on its cost. The rate is the one communicated before booking, per started period of 15 minutes, or that of a new agreement. Only waiting actually performed beyond the included time may be charged.

If the passenger remains absent and unreachable at the end of included waiting, after documented contact attempts and verification of the meeting point, the assignment may be closed as a no-show. The no-show charge follows the late-cancellation cap in Article 8. It does not mean the transport was performed. It is not combined with fictitious waiting charges or expenses not incurred. An error attributable to Blue Prestige or its partner cannot be charged as a passenger no-show.

10. Cancellation by Blue Prestige

If Blue Prestige cannot provide a confirmed service, it informs the client without delay and seeks a replacement of equivalent or higher category at no extra cost. Changes of location, time or essential characteristics require the client's agreement. If no suitable replacement is possible or accepted, the unperformed service is refunded in full within at most 14 days.

For a consumer, where cancellation is attributable to Blue Prestige, compensation at least equivalent to what the consumer would have paid for cancelling at the same time is provided, unless a replacement is accepted. This does not deprive the client of other statutory remedies and compensation; it is credited against compensation for the same loss. The force-majeure rules in Article 15 remain applicable.

11. Delayed, cancelled or diverted flights and trains

Where a usable number has been provided, the welcome time is adjusted to the monitored flight's or train's actual arrival. A public-transport delay before that arrival is not charged as passenger waiting. The included periods in Article 9 begin at the corresponding actual arrival. The client reports any change of number or route.

For a delay exceeding 3 hours or an arrival postponed until the next day, Blue Prestige confirms whether the assignment can be maintained or adapted. If it cannot maintain it and no other solution is accepted, it cancels without charge and refunds the sums received.

In the event of cancellation or diversion, the client informs Blue Prestige as soon as they know. If this information is received before the driver departs for the assignment, cancellation is free. Otherwise, Blue Prestige states postponement conditions or applicable charges within Article 8's limits, taking circumstances and statutory rights into account. The driver's departure must be substantiated.

12. Service delivery and safety

Welcome. The meeting point and a contact number are provided before pickup. The personalised welcome is organised according to the confirmation while limiting exposure of passenger information.

Vehicle. The booking concerns a category with a model ‘or equivalent’, unless a specific model is expressly confirmed. Reference capacities are 3 passengers and 2 bags in Business or Prestige, and 7 passengers and 7 bags in a Van. Dimensions, equipment and bulky luggage may reduce capacity; compatibility is confirmed before ordering.

Passenger numbers and luggage. Exceeding capacity may require another or an additional vehicle after price agreement. No overloading or dangerous pickup is permitted. Any charges for an impossibility attributable to the client remain justified and subject to Articles 8 and 14; they are not automatic if the supplied vehicle does not match the booking.

Children. Age and seating needs are reported before booking. A child seat is provided on request: specify the child's age when booking so an approved restraint suited to their build, compatible with the vehicle and correctly installed can be prepared. Private-hire vehicles do not benefit from the exemption specific to taxis: children under ten must use the restraint required by the French Highway Code, subject only to its statutory exceptions. Without a suitable restraint where required, the child cannot be transported.

Unaccompanied minors. Their pickup requires prior written agreement specifying handover and collection conditions and authorisation from the legal representative. Without this, the enquiry cannot be confirmed.

Animals and assistance. Small animals in a suitable carrier or bag require prior agreement. Guide and assistance dogs have statutory access without a supplement for their presence. Assistance needs are prepared with the team; no medical diagnosis is requested for a simple information enquiry.

On board. Seat belts are compulsory where fitted. Smoking, vaping and consuming alcohol or food are prohibited. The driver may refuse or interrupt transport in cases of danger, violence or unlawful behaviour while ensuring people's safety. Financial consequences depend on the circumstances and substantiable loss; mandatory rights remain applicable.

Damage. Exceptional cleaning or repair costs may be requested only for established damage attributable to the person liable to remedy it. They are proportionate to actual cost, substantiated and may be disputed. Simply booking for another person does not automatically make the booker liable for every damage caused by the passenger.

Languages and lost property. A language other than French is guaranteed only if confirmed in writing. Found items are reported and retained for 30 days before referral to the appropriate service according to their nature. Return is arranged with the owner at actual costs disclosed and accepted. This procedure does not exclude legally established liability.

13. Luggage and associated services

Luggage accompanying passengers must be declared with its relevant dimensions and safely positioned. Passengers keep valuables with them where possible. No custody clause removes Blue Prestige's or the operator's statutory liability for the confirmed service; compensation is assessed under applicable rules.

‘Fast track’ is an airport service performed by a separate provider according to access, times and conditions authorised by the airport. It guarantees neither boarding, passage through police or security checks nor an absolute transit time. The quotation specifies the provider, content, access conditions, charges and cancellation rules.

Unaccompanied luggage transport requires a separate quotation identifying the carrier, collection, delivery, insurance, exclusions and applicable compensation rules. A provider's limits cannot be imposed merely by referring to a document not supplied. Valuables, cash, identity documents, essential medication and dangerous goods are not accepted in the contemplated service.

These associated services cannot be confirmed solely on the basis of these Terms: their specific conditions, classification and withdrawal information must be finalised and accepted before ordering. No liability exclusion may remove mandatory guarantees.

Conditions for child seats and minors
A child seat is provided on request. Request it when booking and specify the child's age.
Conditions for airport welcome services
The chauffeur's name-board welcome in the arrivals area is included in airport transfers. On request, fast-track access through checks may be arranged to reduce waiting; availability and price are confirmed in writing before the service. Aircraft-door welcome services are not offered.
Conditions for separate luggage transport
Separate luggage transport is not currently offered.

14. Liability

Under Article L. 3142-3 of the French Transport Code, Blue Prestige is strictly liable to the client for proper performance of obligations arising from the transport contract, whether performed by itself or another provider, without prejudice to its recourse against that provider. This principle also applies in business relationships.

Blue Prestige may be wholly or partly exempted from this liability only under the conditions prescribed by law, by establishing that non-performance or improper performance is attributable to the client, an unforeseeable and insurmountable act of a third party unconnected with provision of the service, or force majeure. An operator assigned the journey is not, in that capacity, a third party unconnected with its provision. The driver's independence alone does not constitute an exemption.

The programme must allow a margin appropriate to traffic and the airline's or railway operator's deadlines. The client communicates their requirements. Blue Prestige flags a clearly unsuitable time and proposes a realistic solution. The client's requested time does not release Blue Prestige from its own information and performance obligations.

No provision of these Terms limits compensation for personal injury, covers gross negligence or wilful misconduct, or deprives an essential obligation of its substance. Consumers' mandatory rights are preserved.

15. Force majeure

Force majeure is assessed against Article 1218 of the French Civil Code. A strike, weather event, demonstration, road closure or accident is not automatically force majeure: its characteristics and effects on the assignment must be established.

The prevented party informs the other as soon as possible and seeks a solution. If the service can no longer usefully be performed on the agreed date, it is cancelled without charge and sums corresponding to the unperformed part are refunded. Postponement requires the client's agreement. The statutory consequences of temporary or permanent prevention remain applicable.

16. Complaints

Send your complaint to contact@blueprestigemobility.com or to the registered office, with the assignment reference and useful information. Reporting within 7 days is recommended to facilitate checks; this is neither a forfeiture deadline nor a reduction of statutory time limits for legal action. Blue Prestige aims to respond within 15 days and informs you if review requires more time.

17. Consumer mediation

Following a prior written complaint that has not resolved the dispute, a consumer may refer it free of charge to the consumer mediator covering Blue Prestige, under Articles L. 612-1 et seq. of the French Consumer Code, notably within one year of that written complaint. Mediation is optional for the consumer and does not remove their right to go to court.

Mediation referral procedure
After first submitting a written complaint to Blue Prestige without receiving a satisfactory response, a consumer may refer the dispute to CM2C free of charge online, by post to the address above or by email to litiges@cm2c.net. Telephone: 01 89 47 00 14. The referral must be made within one year of the written complaint, subject to the applicable admissibility conditions. This procedure concerns consumer disputes and does not apply to disputes between businesses.

18. Right of withdrawal

Passenger transport contracts fall within the exclusion in Article L. 221-2, 9° of the French Consumer Code: they do not benefit from the 14-day withdrawal period applicable to many distance contracts. Cancellation conditions in these Terms remain applicable, together with mandatory provisions specific to this transport.

This exclusion does not automatically extend to separately sold associated services. The quotation must distinguish the services concerned and state either the withdrawal right and arrangements or the precise basis for its absence. For a service benefiting from that right, early performance requires the express request prescribed by law; loss of the right after full performance requires the statutory conditions and express agreement. A general acceptance box for the Terms is insufficient. Transport of goods scheduled for a specific date must notably be assessed under Article L. 221-28, 12°.

19. Provisions specific to business clients

19.1. Account opening and orders

The client provides its legal identity, company and VAT identifiers where applicable, billing address, an authorised contact and, if necessary, a recent registration extract or equivalent document. Account opening and monthly arrangements are confirmed in writing. The first assignment remains payable in advance under Article 6 unless a written exception is agreed. Purchase orders and mandatory references are specified before the assignment.

19.2. Late payment

For relationships subject to Article L. 441-10 of the French Commercial Code, any late payment incurs penalties from the day after the due date without prior reminder, calculated at an annual rate of three times the applicable statutory interest rate, never below the statutory minimum. They are calculated on the unpaid amount including tax, pro rata to days overdue. A fixed €40 recovery fee is due per overdue invoice. Additional compensation may be requested with supporting evidence where incurred costs exceed that amount, subject to statutory exceptions. These particulars also appear on invoices.

19.3. Confidentiality and organisation

Non-public information about travellers, their journeys and the client's organisation is used for the assignment and statutory obligations. Disclosure is limited to people and providers who need it. A specific agreement may detail agreed enhanced measures. Data-sharing arrangements do not authorise commercial reuse by partners.

19.4. Liability and specific conditions

Article 14's liability rules also apply to business clients. These Terms provide neither an automatic cap at the assignment price, a general exclusion for missed appointments nor a general non-solicitation obligation. Any specific provision negotiated in a framework agreement must comply with mandatory rules, be proportionate and be expressly accepted.

19.5. Territorial jurisdiction between traders

ONLY WHERE BOTH PARTIES HAVE CONTRACTED AS TRADERS, and subject to mandatory jurisdiction, disputes fall within the territorial jurisdiction of the competent Paris courts, including the Paris Economic Activities Court where the dispute falls within its jurisdiction. This clause must be brought very prominently to the client's attention under Article 48 of the French Code of Civil Procedure. Ordinary jurisdiction rules apply to other professionals and non-professionals.

20. Personal data

AZUP AUTOMOBILES processes information useful for enquiries, assignment performance, billing and professional obligations. Data supplied to the operator or an associated provider is limited to the service concerned. A person booking for a third party must send them the information link; Blue Prestige remains subject to its own information obligations.

Passenger contact details are not used for marketing without their agreement. Marketing to business contacts in connection with their role follows the separate rules and right to object described in the privacy policy. Acceptance of the Terms does not constitute consent to marketing or health-data processing.

21. Intellectual property

Booking grants no exploitation rights over Blue Prestige's trading name, logo or content. Their use remains subject to rights actually held and statutory exceptions. Blue Prestige is a trademark registered with the INPI under number 5105847.

22. Applicable law, language and disputes

The Terms are drafted in French and governed by French law. This choice does not deprive a consumer of mandatory protections, including those of their country of residence where applicable rules provide for them. Any translation supplied must specify its status without reducing these rights.

Consumers may bring proceedings before courts designated by law, including those provided for in Article R. 631-3 of the French Consumer Code. A complaint or mediation is not imposed as a waiver of access to a court; any statutory procedural obligations remain applicable. For business clients, see Article 19.5.

23. Applicable version and retention

The version applicable to a booking is the one communicated and accepted when it was concluded. A later website change does not replace it. Blue Prestige retains evidence of the order, price and accepted conditions for the applicable periods and enables the client to obtain a copy. Electronic-contract archiving obligations apply where their conditions are met.
